Larceny and Fraud

Dishonesty does not identify the offence by itself. Larceny focuses on the unlawful taking and carrying away of property belonging to another with the required contemporaneous dishonest intention. Fraud focuses on deception or dishonest conduct producing the specified gain, loss or property result. Transaction timelines help locate representations, consent, possession, disposal and intention.

When both routes appear available, the answer should compare their mechanisms and explain which better characterises the transfer. Begin by identifying the property interest and tracing possession or control through each event. A temporary transfer, mistaken payment, borrowing arrangement or later sale may alter which offence route is available and when the required state of mind must exist.

For larceny, avoid using later dishonest conduct as a substitute for contemporaneous intention at the taking; instead, explain any inference that the later act permits about the earlier state. Consent must be attached to the particular transfer and evaluated for legal effectiveness rather than assumed from physical delivery alone.

For fraud, identify the representation or dishonest conduct, the person or process affected, the specified gain or loss and the causal connection between them. A lie followed by a transfer does not prove causation if verification, an independent reason or another decision-maker produced the result. Alternative charges should be presented as distinct mechanisms, not accumulated labels for the same moral judgment.

State how the prosecution characterises the transfer under each route, which element the evidence best supports and where proof may fail. A transaction chart with columns for time, property, representation, consent, possession and intention forces the analysis to locate each fact. It also helps distinguish an incomplete attempt, a completed offence and later conduct relevant only as evidence.

The final conclusion should explain why the selected offence fits the way the property or benefit actually moved.

A borrowed camera sold under a false story

Q [5 marks]. A person borrows a camera for a stated family event after already arranging its sale online, then sells it immediately. Compare larceny and fraud. The five points shown are an AskSia practice allocation, not a university marking scheme.

  • +1Map ownership, limited possession and the timing of dishonest intention.
  • +2Test the legal effect of apparent consent for the larceny route.
  • +2Link the false purpose to the transfer and resulting gain or loss for fraud.
The owner retains the relevant property interest while lending limited possession. The pre-arranged sale strongly supports dishonest intention from the outset. Fraud is the clearer route because the false purpose induces the handover and produces the property transfer. Larceny depends on the legal treatment of consent obtained by that false story.
Sia tip — Draw representation, consent, possession and disposal as a timeline. Write the alleged intention beneath each point.
Glossary

The legally recognised subject of ownership or possessory interests for the offence.
Possession

Taking
The acquisition or movement of property required by the larceny route.
Deception
A false representation or misleading conduct alleged to produce the fraud result.
Dishonest intention
The required culpable purpose assessed at the time specified by the offence.
FAQ

Larceny and Fraud FAQ

Why does timing matter for larceny?

The dishonest intention must coincide with the taking as required by the offence. A later decision to keep lawfully borrowed property cannot simply be backdated. Later concealment or sale may prove the later state, but the original acquisition still needs its own analysis.

Is every lie a completed fraud?

No. Identify the deception or dishonest conduct, the required gain, loss or property result and the causal connection. A false statement that is detected before anyone transfers property or suffers the specified result may not complete the fraud route.

How should alternative charges be presented?

Apply each offence to the same transaction without changing the facts. State the mechanism that makes one route stronger and identify the element that weakens the other. This is more useful than concluding that dishonest conduct must fit every property offence.

Study strategy

Exam move

Create two flowcharts. For larceny, move through property relationship, taking, lack of legally effective consent and contemporaneous dishonest intention. For fraud, move through deception or dishonest conduct, the specified gain or loss and causation. Apply both to transactions involving borrowing, mistaken payments, false authority and later conversion.

Mark the exact time at which possession changes and intention is alleged. Do not use a later sale as a substitute for proving the original state of mind. For fraud, change the response to the lie: reliance and transfer, verification and refusal, or transfer for an independent reason. Explain how causation changes.

Finish each practice with a route comparison that names the better charge and the evidential weakness of the alternative. The goal is to select a legal mechanism, not merely to describe behaviour as dishonest.
