Repeat Infringer Policy

Policy Statement

AskSia Inc. (“AskSia”) has adopted the following policy toward copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”) and other applicable laws. AskSia will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of the copyrights of others.


Definitions

“Strike” means a recorded instance in which content uploaded or shared by a user has been removed or access to it has been disabled in response to a valid DMCA takedown notice, a court order, or AskSia's reasonable determination that the content infringes the copyright of a third party.

“Repeat Infringer” means a user who has accumulated three (3) or more active strikes within a rolling twelve (12) month period.

“Active Strike” means a strike that was recorded within the past twelve (12) months and has not been reversed through a successful counter-notification or other resolution process.


Strike System

How Strikes Are Issued: A strike is issued when:

1.

AskSia removes or disables access to a user's content in response to a valid DMCA Takedown Notice submitted by a copyright holder or their authorized agent;

2.

AskSia removes or disables access to a user's content based on a court order requiring such removal; or

3.

AskSia removes or disables access to a user's content based on AskSia's own reasonable determination that the content is clearly infringing, such as when the content consists of complete copies of commercially published textbooks, examination papers, or other materials for which the user obviously does not hold the copyright.

Strike Consequences:

1 Strike: Infringing content is removed. User is notified by email of the violation and warned of consequences for further violations. User retains full access to all Services.

2 Strikes: Infringing content is removed. User is notified by email. User's ability to share content in AskSia Library is suspended for 30 days. User retains access to all other Services.

3 Strikes: User's account is terminated. All content shared by the user is removed from AskSia Library. User is permanently banned from the Services.

Strike Expiration: Strikes expire on a rolling 12-month basis. A strike that is more than 12 months old becomes inactive and no longer counts toward the repeat infringer threshold. However, AskSia retains a permanent record of all strikes for enforcement and pattern-detection purposes.

Accelerated Termination: AskSia reserves the right to terminate a user's account immediately and without accumulating strikes in the following circumstances:

The user uploads a large volume of clearly infringing material in a short period;

The user re-uploads content that was previously removed in response to a valid takedown notice;

The user creates new accounts to evade enforcement of this policy;

The user removes, alters, or falsifies copyright management information;

The user's conduct indicates a deliberate pattern of willful copyright infringement.


Notification to Users

When a strike is issued, AskSia will notify the affected user by email at the email address associated with their account. The notification will include:

1.

A statement that content has been removed or access disabled due to a copyright infringement claim;

2.

Identification of the content that was removed;

3.

The current number of active strikes on the user's account;

4.

Information about the consequences of additional strikes;

5.

Information about the DMCA counter-notification process if the user believes the removal was made in error.


Counter-Notification and Strike Reversal

If a user files a valid DMCA counter-notification and the original complaining party does not file a court action within the statutory period (10-14 business days), AskSia will:

1.

Restore the content that was removed;

2.

Reverse the associated strike on the user's account.

A reversed strike does not count toward the repeat infringer threshold.


Account Termination Appeals

A user whose account has been terminated under this policy may submit a written appeal to copyright@asksia.ai within 30 days of termination. Appeals will be reviewed on a case-by-case basis. AskSia is not obligated to reinstate any terminated account and its decision on appeals is final.


Record Keeping

AskSia maintains records of all takedown notices received, counter-notices filed, strikes issued, and account terminations carried out under this policy. These records are retained for a minimum of five (5) years.


Modifications

AskSia reserves the right to modify this Repeat Infringer Policy at any time. Updated versions will be posted on our website with an updated effective date.
