Judicial Review Jurisdiction and Standing

A judicial review answer needs a lawful doorway into court before it can discuss grounds. Start by identifying the court, the statutory or constitutional jurisdiction invoked, and the decision, conduct or failure targeted.

The Administrative Decisions (Judicial Review) Act and section 39B pathways have different threshold language, so they should be pleaded and analysed separately even when both might support Federal Court proceedings. Alternative routes are useful only when every route is matched to its own elements. Characterising the target is a substantive step.

A communication may record an intermediate opinion, recommend action, announce a final decision or merely describe future intentions. Ask what the statute treats as operative, whether the step has legal effect, and whether a later act completes the process.

Challenging the wrong event can defeat an otherwise strong ground because the chosen jurisdiction may require a decision of a particular kind or conduct connected with making one. Standing asks whether this applicant has a sufficient connection to seek relief. The strongest analysis identifies concrete effects on property, business, liberty, reputation, access to a benefit or another legally recognised interest.

General concern that government obey the law may not be enough. Public-interest circumstances can matter, but they must be connected to the standing test that governs the selected route. Describe the applicant's practical stake rather than relying on labels. A disciplined threshold sequence prevents wasted argument.

Name the impugned act, locate the legal source of jurisdiction, test whether the act falls within the route, establish standing, and note any timing or procedural barrier. Only after those questions should the answer move to grounds. If one threshold is uncertain, argue a properly supported alternative rather than assuming the court can reach the merits of the legality complaint.

The conclusion should connect jurisdiction to useful relief. State which route is strongest, who has standing under it, and what order could address the operative act. If an intermediate report is not reviewable but the final statutory decision is, redirect the challenge. If the ADJR Act definition is doubtful, explain whether section 39B supplies another basis.

This structure turns threshold doctrine into practical litigation advice instead of treating jurisdiction as a ceremonial introduction.\n\nProcedural choices can matter as much as substantive grounds. A claimant who identifies the wrong respondent, waits beyond a statutory period or seeks an order unavailable on the pleaded route may lose practical protection despite a plausible allegation of error.

Use the problem facts to flag those issues without inventing barriers that the question does not supply. Revision should pair every jurisdiction rule with a one-sentence factual bridge. For a decision requirement, identify finality and legal effect. For an enactment connection, explain how the statute gives the act force. For an officer requirement, connect the office to the Commonwealth.

For standing, name the affected interest. These compact applications make threshold analysis efficient and leave time for the contested grounds while still earning the marks allocated to jurisdiction.\n\nThreshold analysis should be proportionate. Straightforward elements can be established in a precise sentence, while genuinely disputed finality, enactment or standing issues deserve fuller treatment.

Allocate time according to contestability, but never omit the factual link. This balance protects marks without allowing jurisdiction to consume the entire problem answer.

FAQ

Judicial Review Jurisdiction and Standing FAQ

Is every adverse communication a decision?

No. Test finality, substance and statutory legal effect. An intermediate opinion may be conduct rather than the operative decision that should be targeted for review. Read the statutory process as a whole and identify which step actually changes rights, duties or legal position.

Why plead more than one route?

Alternative ADJR Act and section 39B routes can protect a Federal Court claim if one threshold fails. Each route must still be applied separately to its own elements, target and available relief. Pleading alternatives does not excuse a missing jurisdictional fact or standing connection.

How is standing shown?

Identify concrete effects on property, business, liberty, reputation or another protected interest. General concern for lawful administration may not establish the required connection. Explain how the impugned act affects this applicant in practice and relate that effect to the standing rule for the selected jurisdiction.

Exam move

Build a forum and source matrix, then practise one sentence of factual application for every element. Target the legally operative decision and connect standing to specific consequences before moving to grounds.
