BUSI1001 Chap.7 Data Governance and AML
Data Governance and AML
Data compliance starts with coverage. The Privacy Act 1988 (Cth) and Australian Privacy Principles apply to specified agencies and organisations, with qualifications including small-business exceptions. Personal information is information or opinion about an identified or reasonably identifiable individual, whether true and whether recorded.
A problem answer should identify the entity, information, collection or handling act and any coverage exception before moving to breach response.
The Australian Privacy Principles organise the life cycle of personal information, including collection, use, disclosure, security and access. A data incident is not analysed only as a technical failure.
Identify what information was affected, who could be identified, how unauthorised access or disclosure occurred, likely harm and the entity's response. Eligible data-breach notification and regulator action require their own thresholds and should not be assumed from the existence of any cyber event.
The course also introduces a statutory privacy tort through the 2024 reform material.
Its stated pathway includes a reasonable expectation of privacy, an intentional or reckless and serious invasion, and balancing privacy public interest against countervailing public interest. Damage need not be proved under the stated rule.
Keep this civil cause of action separate from APP compliance, notification and regulatory consequences.
Cross-border disclosure requires attention to destination, recipient and the legal basis relied upon. Health information and Consumer Data Right information may attract particular controls.
CDR supports consumer access and transfer of designated data in structured form to accredited third parties and is co-regulated by the ACCC and OAIC. Data transparency asks whether people can understand collection, storage, use and sharing, not merely whether a policy exists.
AML/CTF analysis begins by asking whether a business provides a designated service with an Australian link and is therefore a reporting entity.
The compliance pathway includes enrolment with AUSTRAC, a written risk-based program before providing the service, customer identification, auditable records and required reports.
Identify the regulated service and relationship rather than assuming every business handling money falls within the regime.
The course identifies threshold transaction reports for relevant currency transactions of A$10,000 or more, international funds transfer instructions of any value, cross-border movement reporting at A$10,000 or more and suspicious matter reports for suspicious interactions.
These thresholds and reforms are time-sensitive. Use the course proposition for course analysis, but verify legislative currency before giving operational compliance advice.

Worked example · free
A provider, a breach and suspicious transfers
- 1Identify the records as likely personal information and confirm organisational coverage before applying duties.
- 2Separate security and eligible-data-breach assessment from the technical incident itself.
- 2Identify affected individuals, likely harm, containment, assessment and any notification pathway.
- 1Confirm designated-service and reporting-entity status for the AML/CTF analysis.
- 2Classify international-transfer reporting separately from suspicious-matter reporting and preserve factual uncertainty.
Key terms
- Personal Information
- Information or opinion about an identified or reasonably identifiable individual, whether accurate and whether recorded.
- Privacy Principle
- One of the Australian Privacy Principles governing stages such as collection, use, disclosure, security and access.
- Eligible Data Breach
- A statutory breach category requiring threshold analysis of access, disclosure or loss and likely serious harm.
- Consumer Data Right
- A regulated framework enabling access to and transfer of designated consumer data to accredited recipients.
- Designated Service
- A service specified by AML/CTF legislation whose provision with the required link can create reporting-entity obligations.
- Suspicious Matter Report
- A report to AUSTRAC concerning interactions that meet the applicable statutory suspicion threshold.
Data Governance and AML FAQ
Is every cyber incident an eligible data breach?
No. First identify coverage and personal information, then assess the nature of unauthorised access, disclosure or loss and the applicable likely-serious-harm threshold. Containment and investigation remain important even where notification is not ultimately required. Do not infer the statutory category solely from the seriousness of a technical outage.
How is CDR different from ordinary privacy compliance?
CDR creates a structured access and portability framework in designated sectors, including transfer to accredited recipients under its safeguards. General privacy rules govern broader handling of personal information. The same organisation may face both regimes, but coverage, data categories, actors and consent or authorisation pathways must be mapped separately.
What makes a business an AML reporting entity?
The key question is whether it provides a designated service with the required Australian link. Handling money in a general sense is insufficient. Once coverage is established, enrolment, a risk-based program, customer identification, record keeping and transaction or suspicion reports can form part of the compliance pathway.
Why should thresholds be date-checked?
Privacy and AML/CTF regulation changes through amendments, sector designations, rules and commencement dates. A proposition accurately taught for the course may not be safe operational advice later. Preserve the stated course rule for assessment, but identify its date and verify official legislation and regulator guidance before real-world implementation.
Exam move
Create a coverage-first flowchart. For privacy, move through entity, information, handling act, APP duty, incident threshold, response and regulator. For CDR, add sector, designated data, consumer direction, accredited recipient and safeguards. For AML/CTF, move through designated service, Australian link, reporting entity, program, customer identification, records and report category.
Test the chart with three contrasting entities, including one that may fall within an exception. Memorise report names by trigger rather than abbreviation alone. On every practice answer, write a currency note next to thresholds and reforms. Because this topic is excluded from the captured exam announcement, use the chapter for course mastery and compliance literacy while checking the current final scope separately.
