HIRAC and Case-based Problem Solving

Define HIRAC

The course material gives this chapter a concrete anchor: Session 5 turns case analysis into an issue-by-issue HIRAC workflow. That HIRAC anchor controls how material fact is explained and how analogy is tested in changed practice.

HIRAC and Case-based Problem Solving asks how HIRAC, material fact and analogy change the interpretation of a text, case, institution or public problem.

The chapter's practical task is to write a two-sided application that links every material fact to authority; that requires an argument, not a list of themes.

Define HIRAC at the scale of the chosen case. Identify who uses the category, what it makes visible and what it may conceal.

This prevents the HIRAC definition from floating above the evidence as an interchangeable opening paragraph.

Use material fact to explain the relationship between the case and the claim. Quote, describe or compare only the evidence that advances material fact, and make the inferential step visible instead of assuming the example speaks for itself.

Bring analogy in as a second lens or consequence.

The analogy reading may deepen the first account, expose a conflict or show why another audience would interpret the same material differently. The comparison should change the conclusion, not simply add another term.

To write a two-sided application that links every material fact to authority, build each paragraph around one contested move: claim, specific evidence, explanation and qualification.

A analogy counter-reading is strongest when it identifies exactly which premise or piece of evidence it changes.

Trace material fact

Make an evidence table for HIRAC with four columns: passage, image, event or institutional fact; the concept it activates; the inference drawn; and a plausible competing reading. Place HIRAC and material fact in separate rows before combining them.

This keeps material fact interpretation anchored in specific material and shows where disagreement enters the argument.

Test the scale of every claim. A detail involving HIRAC may support an argument about one text, group or moment without supporting a claim about an entire culture or institution.

Use analogy to decide whether the evidence should be widened, narrowed or compared with a counter-case before the paragraph reaches its conclusion.

For timed revision in laws8586, write a one-sentence thesis for the application — write a two-sided application that links every material fact to authority — then list the minimum evidence needed to defend it.

Add one analogy objection that would matter if true and revise the thesis so it survives. The exercise trains analogy argument selection and qualification rather than a memorised inventory of course terms.

A complete response should make the task visible before the detail: identify what must be decided, define the relevant terms, connect the evidence to material fact, and use analogy to test the result.

The final sentence about analogy should answer the question actually asked rather than merely repeat the topic.

The controlling limit is specific: a labelled structure without precise rule and application remains incomplete.

Keep that analogy limit beside the worked example, because it separates a careful laws8586 answer from one that sounds confident but claims more than the task or evidence supports.

For revision, retrieve HIRAC, material fact and analogy without notes, explain their relationship aloud, then complete a changed version of the application: write a two-sided application that links every material fact to authority.

Record the first failed material fact reasoning move and repair it before attempting another case.

Apply HIRAC

Q [4 marks]. AskSia-authored practice. A new case changes the actor, evidence or operating condition behind HIRAC. How should the analysis be rebuilt?
  • 1Define the decision and the relevant HIRAC evidence.
  • 1Explain how material fact changes the result.
  • 1Use analogy as a check or comparison.
  • 1State the conclusion and the condition that would change it.
Define HIRAC, trace its relationship with material fact, then use analogy to test and qualify the conclusion.
Sia tip — Keep the conclusion conditional on the evidence supporting HIRAC.

FAQ

HIRAC and Case-based Problem Solving FAQ

What should a student check while trying to write a two-sided application that links every material fact to authority?

Write a two-sided application that links every material fact to authority. Session 5 turns case analysis into an issue-by-issue HIRAC workflow. Problem-solving structure organising heading, issue, rule, application and conclusion. This chapter uses the concept when students write a two-sided application that links every material fact to authority.

Which condition in this chapter explains why a labelled structure without precise rule and application remains incomplete?

A labelled structure without precise rule and application remains incomplete. Fact capable of affecting the legal issue, rule or result. It helps explain the reasoning required to write a two-sided application that links every material fact to authority.

If a student were to reverse one fact, how should they rebuild the strongest analogy, distinction and conclusion?

Define HIRAC, trace its relationship with material fact, then use analogy to test and qualify the conclusion. A labelled structure without precise rule and application remains incomplete.

Study strategy

Exam move

Reconstruct the relationship among HIRAC, material fact and analogy; complete the chapter application without notes; then test the result against this limit: a labelled structure without precise rule and application remains incomplete.
