ACT505 Chap.2 Property Tax Scope and Basis Period
Property Tax Scope and Basis Period
Start with the charge
Property tax applies for each year of assessment to the owner of land or buildings situated in Hong Kong and uses net assessable value as its base. The year runs from 1 April to the following 31 March. Draw that period before counting rent, placing premiums or dealing with bad-rent events.
Keep each property separate
Ownership and payment direction are different questions.
Allowing another person to collect or keep rent does not by itself move the charge away from the owner.
Where a taxpayer owns several properties, keep individual timelines and workings so vacancy, owner-paid rates or irrecoverable consideration attached to one property does not leak into another.
Make the timeline carry the facts
Mark lease commencement, lease termination, vacancy, re-entry, re-letting, the date rent becomes accepted as irrecoverable and any later recovery.
Beside each occupation period, record the monthly rent and who bears rates or management fees.
The line then becomes the source for month counts and keeps later contractual terms from being applied backward.
Distinguish ownership from enjoyment
The owner test is not displaced merely because a relative or agent collects rent, because a tenant bears some outgoings, or because financing gives another person security over the property. Copy the exact relationship stated in the facts.
When a mortgagee is in possession or ownership is otherwise unusual, give that status its own line rather than inferring from the cash recipient.
Flag the profits-tax boundary
Rental income arising from a trade or business may require coordination with profits tax. Keep the property-tax working long enough to show the potential charge, then identify the exemption or set-off question.
Choosing one schedule silently would hide the interaction and could either duplicate or omit tax.

Property Tax Scope and Basis Period FAQ
Who begins the property-tax computation?
Begin with the owner identified by the facts and the scope rule. The person who collects or benefits from rent is not automatically the taxpayer if ownership has not changed. Write an ownership timeline before calculating when the narrative includes a sale, transfer, joint interest or rent paid around a change date.
Match every receipt to the relevant property and period, and distinguish the legal owner from an agent, manager or recipient. Only then build the assessable-value schedule for the correct taxpayer and basis period.
What dates define the property-tax year?
The basis period runs from 1 April to the following 31 March. Place lease starts, lease ends, irrecoverability decisions and later recoveries on that line before calculating the current year.
Why keep different flats in separate schedules?
Bad rent, rates, vacancy and premiums belong to particular properties and periods. Separate schedules stop one property's deduction or receipt from being used against another without authority.
Exam move
Practise with blank timelines. Mark 1 April and 31 March, then add a lease start, lease end, vacancy, bad-rent decision and recovery. Count months aloud and write which year receives each event. Only after the placements agree should you calculate rent. This routine removes timing mistakes before the NAV computation begins. Next label the legal owner and payment responsibilities for every occupation period.
Use a separate line for each property, even if one taxpayer owns several. Finish by asking whether business use creates a profits-tax coordination issue and note the exact rule location in the permitted materials.
