LAW4323 Chap.3 Privilege
Privilege
Privilege protects defined interests through specific statutory categories. Self-incrimination, client legal privilege and protected communications must not be merged into broad confidentiality. Identify the holder, precise answer or communication, governing purpose and any loss or exception. The conclusion states what cannot be compelled or adduced and the procedure that follows.

Privilege FAQ
Is every confidential document privileged?
No. Confidentiality may be necessary, but material must fall within a defined privilege and satisfy its purpose and scope. Private information is not automatically privileged.
Who holds client legal privilege?
The client ordinarily holds the protection even when a lawyer possesses the communication. That distinction matters when analysing disclosure, deployment, waiver and any authority to relinquish protection.
Does sending a document to counsel protect it?
Not by attachment alone. Analyse the document's creation and character separately from the request for legal advice and the advice that accompanies it in the communication.
Exam move
Organise privilege revision around protected interests instead of the broad word confidential. Make three folders for self-incrimination, client legal privilege and protected communications in sexual-offence matters. For every problem, complete an audit containing category, holder, precise material, statutory purpose, possible loss or exception, and procedural consequence.
In client legal privilege exercises, separate the client from the lawyer who possesses the document, then separate a pre-existing record from the communication requesting or giving legal advice. Practise dominant-purpose analysis by listing every purpose suggested by the facts and identifying which controlled creation of the communication or document.
Do not allow later transmission to rewrite why an old record originally existed. Add a waiver column that records the conduct said to be inconsistent with maintaining protection. Specify what was disclosed, who authorised it, the forensic use made, and why continued confidentiality would or would not be inconsistent. Avoid treating accidental awareness that advice exists as automatic loss.
For self-incrimination, identify the witness, particular question, liability or penalty feared, objection and statutory protective procedure. Compare that route with an embarrassing answer that creates no relevant exposure. For special protected communications, learn the distinct Victorian statutory category and resist importing the client-lawyer purpose test.
Use mixed-document drills to decide whether redaction or severance can preserve protected passages while allowing other material. After every privilege conclusion, ask whether ordinary admissibility questions remain if the protection fails. A non-privileged document can still raise relevance, hearsay, opinion or discretionary issues.
During a timed answer, object to the smallest defensible unit and state the order sought rather than claiming an entire file without analysis. Where facts do not reveal creation purpose, client authority or disclosure circumstances, make the result conditional and identify the missing evidence.
Review by reading only the holder and consequence sentences across your answers; they should never confuse possession with ownership or privilege with admissibility. End revision sessions by converting a narrative email chain into a chronological table of author, recipient, time, purpose and later use. That chronology usually reveals the correct protection and any claimed loss more clearly than a page of abstract doctrine.
AskSia Library · LAW4323 · Evidence · Monash University ALL-TOPICS CHECK Exam morning The all-topics checklist The published materials confirm scope and weight, not duration or permitted aids The examination is worth 60% and the unit information states that it tests comprehension and practical use across the complete topic set. The captured sources do not state duration, question count, permitted materials or a hurdle.
Check the current Monash examination notice and timetable for those logistics rather than relying on an invented format. Topic Opening question Closing move Relevance what fact and rational effect? apply exact exclusion rule Witnesses competence, compulsion or stage? state leave or control Privilege who holds which protection? identify protected material Credibility what purpose?
exception and permitted use Tendency/coincidence which inference? threshold and s 101 Hearsay representation, assertion, purpose? exception and scope Opinion what conclusion and basis? exception and reasoning Admissions what adverse representation? exclusion cascade During reading time Mark each evidence item and each party’s purpose.
Circle facts that change the statutory route: criminal or civil proceeding, prosecution or defence tender, maker availability, personal knowledge, accused status, family relationship, notice, leave, caution, threat or impropriety. Do not start drafting until the tender-purpose pairs are clear.
FIRST PASS ITEM + PROPONENT + PURPOSE + FACT IN ISSUE = ISSUE LIST During writing Use short rule statements followed by dense application. Quote the statutory threshold accurately, then tie every important word to a fact. Give separate conclusions for separate purposes. If facts are missing, state the conditional result and name the missing fact. End with the ruling or procedural step sought. !
Do not invent the exam format The official source captured here gives 60% and all-topic scope only. Confirm duration, sections, question types and aids from current Monash instructions. Reserve a final check for contradictions. Evidence excluded under one route might still be admissible for another purpose, but only if that analysis is written. Ensure no direction silently turns a limited use into full proof.
Check every prosecution tendency or coincidence item for the additional restriction and every criminal admission for the later exclusion gates. {PG} · AskSia AskSia Library · LAW4323 · Evidence · Monash University FINAL AUDIT Final review The last ten-minute audit Correct the route before polishing the prose Scan headings and conclusions rather than rereading every sentence.
Each item should have a fact in issue, tender purpose, governing rule, exception if needed, discretion or limitation, and result. Missing one of these stages is easier to repair than an elegant but misclassified paragraph. Purpose: Have you analysed every distinct use of a statement, opinion, prior act or credibility fact? Threshold: Have you used the provision’s own language rather than a generic fairness or reliability test?
Procedure: Have you stated leave, notice, objection, direction, voir dire, redaction or other practical step where required? Scope: Have you said against whom and for what purpose admitted evidence may be used? Consistency: Does the final evidence set still support each factual proposition your answer relies upon? If time collapses Prioritise classification and conclusion.
A compact answer can state the fact in issue, purpose, rule, decisive fact and result in five sentences. Do not spend remaining time reciting authorities while leaving other tenders unclassified. The unit’s learning outcomes reward selection and application of evidence principles to complex facts, not undirected recall. Purpose first; statutory words second; factual application third; ruling last.
Exam-morning sequence For joined issues, show the handover. A prior representation may begin under hearsay, enter through an exception, then face credibility and discretionary questions. An admission can clear hearsay and opinion yet fail unfairness or impropriety control. Writing the handover prevents one successful exception from erasing every later safeguard.
After the exam, avoid relying on memory of question details when checking answers with classmates. The guide’s job ends at method and revision; official assessment conditions and integrity requirements govern the sitting. Before entering, use the current Monash notice for timing, location, identification and permitted materials. ✓ Closing discipline Write a ruling for every evidence item.
An unresolved paragraph without a procedural consequence is usually an unfinished analysis. {PG} · AskSia
