Relevance and Exclusion

Relevance asks whether evidence, if accepted, could rationally affect a fact in issue. That threshold does not finish admissibility. A complete analysis identifies the proposition and tender purpose, explains the inferential link, then applies any categorical rule, discretionary control or mandatory exclusion. Sections 135, 136 and 137 use different triggers and balances, so their statutory language must remain separate.

FAQ

Relevance and Exclusion FAQ

Does relevant evidence always get admitted?

No. Relevance is an initial threshold. Hearsay, opinion, privilege, credibility or another exclusionary rule may apply, and sections 135 to 137 can exclude or limit otherwise relevant evidence.

What makes circumstantial evidence relevant?

The answer must state the inferential link between the circumstance and the fact in issue. Alternative explanations can weaken that inference without necessarily destroying relevance.

Why keep sections 135 and 137 separate?

They apply in different settings and use different statutory balances. A generic fairness test risks reversing the threshold or ignoring the prosecution-specific criminal rule altogether.

Study strategy

Exam move

Revise relevance by turning every item into a five-line admissibility card. Line one states the precise fact in issue, not the whole charge or cause of action. Line two gives the tender purpose. Line three explains how accepting the evidence changes the probability of that fact, including any intermediate inference. Line four selects the exclusionary rule or discretion.

Line five gives the operational result: admitted, excluded or confined to a particular use. Practise first with simple direct evidence, then with circumstances that require two or three inferential links. For each circumstance, write the strongest innocent or competing explanation and decide whether it weakens probative value or destroys the rational connection entirely.

Build a separate comparison table for sections 135, 136 and 137. Record the proceeding, tendering party, statutory verb, balance and danger addressed by each provision. Cover the provision names and reconstruct the correct threshold from a short fact pattern. This prevents a generic fairness test from replacing the actual statute.

When studying probative value, tie it to a proposition and use rather than describing an exhibit as inherently strong. When studying prejudice, identify the feared misuse rather than saying evidence damages a party. Rework any practice response that uses inflammatory, unreliable or unfair without explaining the reasoning those words perform.

Finish a session by taking one statement with two purposes and writing two complete analyses. A warning might prove notice without proving its contents, while a photograph might establish location but carry a risk from graphic detail. Decide whether redaction, a direction or exclusion targets the danger.

On timed problems, mark every evidence item in the margin, add its proponent and purpose, and do not move to balancing until relevance and classification are visible. During review, compare conclusions against the facts that remain in the case after exclusion. If a ruling removes the only proof of a proposition, state that consequence.

If the source facts do not establish the proposed use, identify the missing link instead of inventing one. This routine makes relevance a working foundation for hearsay, opinion, credibility, tendency and admissions rather than an introductory definition forgotten after the first paragraph.

AskSia Library · LAW4323 · Evidence · Monash University HOW TO USE Front matter How to use this Evidence guide Build an issue map first, then practise purpose-specific admissibility conclusions The unit examines principles and rules governing proof in civil and criminal trials.

Its learning outcomes emphasise identifying legal and factual issues, applying evidence principles to complex scenarios, evaluating authorities and communicating convincing written and oral arguments. This guide follows the teaching sequence and turns each topic into a repeatable problem method. First pass: read each chapter map and learn the order of questions.

Evidence answers fail when a later discretion is applied before the evidence is classified. Second pass: cover the model response and write an issue list from the facts. Compare the sequence, not just the conclusion. Third pass: join topics. A single statement can raise relevance, hearsay, credibility, opinion and discretionary issues, each for a different purpose.

Published assessment structure The captured assessment page lists a Mid-Semester Multiple Choice Quiz worth 10%, a Group Written Submission worth 30%, and an Examination worth 60%. The three numeric weights total 100%. The unit information page states that the final examination tests comprehension and practical use across the complete topic set.

The captured official materials do not state the exam duration, question count, permitted materials or a hurdle, so this guide does not invent them.

Assessment Weight Published detail Mid-Semester Multiple Choice Quiz 10% Week 5 task Group Written Submission 30% hypothetical legal argument Examination 60% all unit topics Use the statutory language Write the rule in the words that determine the threshold, then connect every phrase to a fact. Avoid treating “fairness,” “reliability” or “prejudice” as universal tests. Different sections use different balances.

A short answer that selects the correct provision and explains its operation is stronger than a long answer that lists every rule in the subject. i Practice-paper boundary The LMS states that practice revision exams and a mock-exam platform exercise were made available. All practice in this guide is newly authored and uses only the question types, never copied stems.

{PG} · AskSia AskSia Library · LAW4323 · Evidence · Monash University MASTER MAP Front matter The full admissibility map Keep classification, exceptions and discretions in a stable order A reliable exam method begins with the fact in issue and the purpose of the tender. From there, identify the evidence form and any exclusionary rule. If an exception applies, prove each condition.

Only after that should you address judicial discretions, mandatory exclusions, limitations and directions. Stage Question Typical chapters 1. Relevance what fact and rational effect? relevance 2. Classification representation, opinion, tendency, credibility? hearsay, opinion, character 3. Exception which provision and conditions? hearsay exceptions, admissions 4. Control exclude, limit or direct?

relevance, admissions 5. Trial use against whom and for what purpose? all chapters MASTER METHOD FACT IN ISSUE → PURPOSE → RULE → EXCEPTION → DISCRETION → SCOPE The syllabus sequence is cumulative Witness competence and examination determine how evidence is received. Credibility, hearsay and opinion then regulate particular uses. Tendency and coincidence control pattern reasoning.

Admissions and improper-obtaining provisions combine classification with criminal-process safeguards. Later chapters therefore assume the earlier relevance and purpose discipline. One item of evidence can have several uses; analyse each use separately. Whole-course principle When time is short, do not omit the conclusion. State admitted, excluded, admitted only for a purpose, or unresolved because a named fact is missing.

Then give the practical consequence: a direction, redaction, leave application, voir dire or need for proof from another witness. That operational sentence shows control of evidence law. Revision should alternate isolated rules with integrated problems. Isolated drills build accurate thresholds.

Integrated hypotheticals train the handover between rules, such as a prior statement used first on credibility and later for truth, or an expert report containing embedded hearsay. Record every mistaken handover in an error log and rewrite the sequence that should have been used.

{PG} · AskSia AskSia Library · LAW4323 · Evidence · Monash University ASSESSMENT BOUNDARY Front matter Assessment and source boundaries Use the published weights, then keep unknown logistics unknown The official assessment structure contains three numeric components: the Mid-Semester Multiple Choice Quiz at 10%, the Group Written Submission at 30%, and the Examination at 60%. Together they account for 100% of the unit result.

The handbook record and captured LMS assessment page agree on those figures. Component Weight Preparation focus Quiz / Test 10% accurate rule recognition Written 30% researched legal argument Examination 60% application across all topics What the source confirms The unit information describes the final examination as a test of comprehension and practical use across the complete topic set.

It also describes the written submission as an argument on evidentiary issues in a hypothetical scenario. The LMS revision page says that practice revision exams and a mock-platform timing exercise were made available. Those facts support integrated issue-spotting practice and timed rehearsal.

What the source does not confirm The captured official materials do not state the final duration, section structure, question count, permitted aids or a hurdle. A mock timing environment does not prove the official duration. This guide therefore avoids claims such as open book, closed book, multiple choice, fixed problem count or minimum exam score. Students should consult the current Monash examination notice and timetable.

i Evidence discipline applies to the guide too A missing published detail is recorded as an information gap, not converted into a negative claim or a plausible invented format. Use the assessment weights to allocate revision effort without allowing the 60% final to erase the earlier tasks.

Quiz preparation builds fast statutory classification; the written task develops legal research and structured argument; final revision integrates those skills across the syllabus. The same method supports all three: identify the precise issue, select the governing rule, apply facts and state an operational conclusion. {PG} · AskSia
