Drug Possession and Trafficking

Drug offences require close control of definitions, attribution and purpose. Physical proximity does not by itself establish possession; the analysis must address custody or control and the accused's knowledge and intention under the governing rules. Deemed possession can supply a statutory route but only when its conditions are met.

Trafficking is analytically distinct from possession and may be proved through specified conduct or statutory quantity mechanisms. Every answer should also identify the substance, amount, authorisation question and evidential inference without treating quantity as automatic proof of every element.

Shared premises require separate conclusions for each person, while threshold questions require exact attention to drug, form, unit and Schedule category. The numerical comparison comes after that legal classification.

Distinguish proximity from possession

Q [8 marks]. The mark allocation used is not a university assessment scheme. Police find a prohibited substance in a zipped bag under the passenger seat of a shared car. Dana is driving, Luis owns the car, and both deny knowing the bag is there. Explain the possession analysis for each person.

  • 2Identify the substance and the statutory possession route before drawing inferences from where the bag was found.
  • 2Analyse Dana's custody or control and knowledge separately, using access, location and surrounding facts without treating driving as conclusive.
  • 2Repeat the element analysis for Luis, because ownership of the car does not automatically establish knowledge or control of the bag.
  • 2Test any deemed-possession provision on its exact conditions and state whether reasonable doubt remains for each accused.
The mark allocation shown is not a university assessment scheme; it separates the proof routes for practice. Location and car ownership are relevant circumstantial facts but do not independently prove possession. The prosecution must establish the applicable custody or control and mental requirements, or satisfy a deemed-possession route, for Dana and Luis separately. The conclusion may differ between them and must reflect reasonable doubt.
Sia tip — Create one element table per accused and keep physical access, practical control, knowledge and any deeming route in separate rows.

FAQ

Drug Possession and Trafficking FAQ

Is proximity enough to prove possession?

No. Proximity is circumstantial evidence, not the entire test. Analyse custody or control and the required mental state, then consider any statutory deemed-possession rule. Shared cars, rooms or containers demand person-by-person reasoning because access and knowledge may differ.

Does a large quantity automatically prove trafficking?

Quantity can activate statutory consequences or support an inference, but its role depends on the applicable provision and category. Identify the exact amount, statutory mechanism and trafficking element rather than using size as a conclusion. Also test competing explanations supported by the facts.

How should multiple accused be handled?

Create a separate possession and trafficking analysis for each person. Ownership, occupancy, access, statements and conduct may carry different weight for different accused. Do not transfer one person's knowledge or control to another merely because they share premises or are present together.

What should be checked before comparing a quantity?

Verify the substance, its statutory form, the unit of measurement, the relevant Schedule column and the offence route. Only then compare the proved amount with the threshold. This sequence prevents a correct calculation from being attached to the wrong legal category or consequence.

Study strategy

Exam move

Begin with a statutory vocabulary sheet covering substance, possession, custody, control, trafficking, quantity categories and authorisation. When solving facts, make a separate matrix for every accused and every located item. Put physical access in one row, knowledge evidence in another, and any deemed route in a third.

For trafficking, identify the precise conduct or statutory mechanism rather than inferring the offence from possession alone. Recheck all printed quantities against the governing provision during open-book practice. Build a threshold card that records substance, form, unit, column and legal effect in separate fields.

Practise with shared-space facts by removing one item of evidence at a time and observing which accused's conclusion changes. This trains inference control and prevents ownership or proximity from becoming an unstated presumption of guilt.
