Legal and Non-Legal Representation

Victim lawyers, non-legal advocates, prosecutors and courts perform different functions. This chapter identifies the client, duty, power and limit of each role.

It examines when independent counsel is justified for personal legal interests, how advocacy improves navigation and support, and how standing, funding, confidentiality, referral and judicial case management can protect participation without creating a duplicate prosecution. Prosecutorial independence means the public case is not a personal retainer.

The victim's interests matter, yet they do not automatically produce instructions, privilege or control over charges. Calling the prosecutor the victim's lawyer creates expectations the role cannot meet and obscures the need for separate assistance where a personal legal interest arises. Independent victim counsel is most defensible on defined issues such as privacy, confidential records, questioning or participation rights.

The role can include notice, advice and submissions without leading a second case against the accused. Standing rules, disclosure access and early case management should preserve efficiency, defence response and judicial control. Non-legal advocacy performs another substantive function. An advocate can explain process, coordinate services, prepare questions, attend meetings and follow up information.

The role should not claim legal powers it lacks. A boundary is useful only when a warm referral crosses it, so protocols must connect legal concerns to counsel early enough to act. Access begins before the courtroom. Trigger points can include a request for records, a questioning application or proposed disclosure of identifying material.

Funding, specialist expertise, geography, language and continuity determine whether nominal availability protects the intended interest. Count timing and completed referrals rather than appointments alone. Confidentiality and information sharing differ across roles. The person needs a clear explanation of privilege, consent, records and referral.

A coordinated model combines advocacy and limited counsel while keeping prosecution and court functions distinct. Its success can be evaluated through missed triggers, unresolved issues, delay, understanding and equitable access. A role table is a useful control against overclaiming. For every actor, record whom they serve, the decision they can influence, the information they may hold and the route beyond their authority.

Apply the table to a privacy dispute or questioning application. It will show where counsel is necessary, where advocacy remains valuable and where judicial control cannot be delegated to either role.

Design limited victim counsel

Q [5 marks]. Independent AskSia practice weighting, not a University marking scheme. A reform body proposes a lawyer for every victim in a criminal trial. Build a model that protects personal legal interests without duplicating prosecution.

The role map places the victim at the centre while keeping prosecution, personal legal advice, advocacy and court control distinct.
  • +1Identify personal privacy, records, questioning or participation interests.
  • +1Give counsel notice and standing only on those defined issues.
  • +1Keep prosecution, advocacy and court functions distinct.
  • +1Protect disclosure, defence response and judicial control.
  • +1Add early referral, funding, reasons and monitoring.
Use specialist advocacy for support and navigation, then provide independent legal advice where a separate personal interest arises. Limited standing, early notice and case management protect those interests while the prosecutor conducts the public case and the court controls fairness.
Sia tip — Write client, duty, power and limit before describing any actor as a representative.

FAQ

Legal and Non-Legal Representation FAQ

Why is the prosecutor not the victim's personal lawyer?

The prosecutor conducts the public case and must exercise independent judgment. The victim's interests are important, but the relationship does not automatically create personal instructions, confidentiality or control. Independent advice may be needed where a separate legal interest arises.

What can a non-legal advocate do?

An advocate can explain process, coordinate support, prepare questions, attend meetings and follow up information. The advocate should not claim legal standing or advice powers that do not exist. A reliable referral route must connect legal concerns to qualified counsel.

How can victim counsel avoid duplicating prosecution?

Tie standing to defined personal interests and stages, such as privacy or records. Use early notice and judicial case management, preserve the defence opportunity to respond and keep charging, evidence presentation and verdict within their existing public roles.

Study strategy

Assessment move

Draw the role map with the victim at the centre and prosecutor, lawyer, advocate and court around it. For each, record client, duty, power, confidentiality and referral. Apply the map to a privacy issue and a courtroom-questioning issue. If two roles appear interchangeable in your answer, rewrite the boundary before adding more authority.
