Privacy, Surveillance and Confidentiality

Privacy problems can arise from intrusion, observation, collection, use, disclosure or loss of control over sensitive information. Confidentiality is related but distinct because it depends on circumstances creating an obligation of confidence.

The current legal landscape also includes the statutory tort for serious invasions of privacy that commenced in June 2025. A strong answer identifies the conduct, expectation, seriousness, intent or recklessness and public-interest issues before considering remedies and editorial safeguards.

Investigate misconduct without publishing private bystanders

Q [5 marks]. A hidden camera records a care worker mistreating a resident in a private facility. It also captures other residents in intimate situations. Advise on investigation and publication. The marks used here organise a privacy drill and are not an official University scheme.

  • 1Separate the decision to investigate from the decision to publish identifiable footage.
  • 1Assess expectations of privacy, seriousness and the method of surveillance.
  • 1Identify the strong accountability and safety interest in verified mistreatment.
  • 1Protect uninvolved residents through cropping, blurring and secure handling.
  • 1Seek response and publish only material necessary to establish the conduct.
The mistreatment presents a serious accountability and safety concern, but uninvolved residents retain strong privacy interests. The newsroom should authenticate the footage, investigate the circumstances, notify appropriate safeguarding bodies where necessary and give the worker and facility an opportunity to respond. Any publication should crop or blur bystanders and avoid intimate material not needed to prove the misconduct. Public interest supports exposure, not unrestricted release of everything recorded.
Sia tip — Hidden collection and later publication are separate acts. A justification for one does not automatically justify the other.

FAQ

Privacy, Surveillance and Confidentiality FAQ

How is confidentiality different from privacy?

Privacy concerns intrusion and control over personal life or information. Confidentiality depends on the circumstances in which information was communicated or obtained and the obligation those circumstances create. A fact can be private without having been confided, and information can be confidential without being intimate. The claims can overlap, but their elements and justifications should be analysed separately.

What changed in Australian privacy law?

The current course module dates the statutory action for serious privacy invasion from June 2025. Older materials describing the absence of a general privacy action are therefore historical context, not the complete current position. An answer should use the present statutory test and verify operative provisions and recent authority before applying them.

When can covert surveillance be ethically justified?

Covert methods require a serious public-interest aim, strong reason to believe evidence exists and a convincing case that less intrusive methods will not work. The method should be narrowly targeted, authorised and reviewed. Even when collection is justified, publication should exclude unrelated private material and protect vulnerable people who are not responsible for the conduct under investigation.

Does information lose privacy once it is online?

Not automatically. Accessibility, intended audience, sensitivity, age, searchability, method of access and proposed reuse all matter. A post shared within a limited group can retain strong privacy significance when republished to a mass audience. Analyse the new publication context and seek consent or minimise identification unless a compelling public-interest reason supports wider use.

Study strategy

Assessment move

Draw separate branches for intrusion, private information and confidentiality. Under each, list conduct, expectation or obligation, seriousness, justification and remedy. Mark the June 2025 statutory change beside older privacy notes so the historical and current positions cannot be confused. Practise scenarios in two stages: may the newsroom gather the information, and may it publish it?

For every justified investigation, add a minimisation plan covering access, storage, redaction, identification and eventual deletion. Take a mixed dataset and classify every field as necessary evidence, useful context or unrelated sensitive material. Design separate controls for acquisition, newsroom access, analysis, publication and retention.

Then change the subject from an elected official to a private witness and note which expectations and public-interest arguments shift. This exercise makes the fame factor contextual rather than a blanket loss of privacy and shows why responsibility continues after a decision not to publish a detail.

End by naming who may access retained material, for how long and under what deletion trigger, because unpublished data can still create serious exposure.
