Private Credit and Emerging Finance Regulation

The research essay focuses on current regulatory developments, and this chapter prepares the ground.

It sets out the opening seminar's 2025 estimates of the Australian corporate debt, equity and consumer debt markets, the issues ASIC's 2024 discussion paper identified in private credit, and the four 2026 essay topics on private credit, tokenised bank deposits, agentic AI in banking and the digital assets framework, with a method for narrowing a regulator's concern into a bounded research question.

The chapter connects the opening seminar to the essay. The market estimates show the scale of corporate and consumer debt, and the private credit slide records the issues ASIC raised in 2024: complex and overlapping regulation, the reliability of private asset valuations and disclosure to retail investors.

The four 2026 topics then ask whether Australian law is equal to private credit, deposit tokenisation, agentic AI in banking and digital asset platforms. Each topic is summarised by its anchor document and the question it asks, and a worked scope paragraph shows how to narrow a regulator's concern into an aim a 6,000-word essay can achieve.

Q [4 marks]. Independent AskSia practice weighting, not a University marking scheme. Using the opening seminar's 2025 estimates, compare corporate debt with listed equity and all consumer debt, and say what the comparison suggests for a regulatory essay.

  • +1Read the estimates: corporate debt about 1.2 trillion, listed equity about 2.7 trillion.
  • +1Add consumer debt at about 3.1 trillion, with non-mortgage consumer debt at 0.23 to 0.25 trillion.
  • +1Note that corporate debt plus equity is about 3.9 trillion before adjustment for overlap.
  • +1Use the figures as context for why regulators care, not as legal argument.
Consumer debt is the largest of the three at about AUD 3.1 trillion, ahead of listed equity at 2.7 and corporate debt at 1.2. The numbers explain why regulation matters but cannot by themselves show a framework is adequate.

FAQ

Private Credit and Emerging Finance Regulation FAQ

Which essay topic should I choose?

Choose the topic whose primary material you can locate quickly. The sample plan says a plan naming particular reports, cases or provisions beats one that only gestures at relevant laws, and the plan fixes your topic for the essay, so read all four before committing.

How much should a tokenisation essay explain the technology?

Only as much as the legal argument needs. The topic sheet asks for analysis of the Australian legal framework, so space spent describing how ledgers work is better used on issues the topic names, such as settlement finality, licensing and prudential treatment.

Can I compare Australia with other countries?

Yes, but only to sharpen the analysis of Australian law. The topic sheet says international materials should sharpen that analysis rather than form a general comparative survey, and the sample plan asks you to explain why a chosen comparator is useful.

Do the essay topics require international comparison?

No. International material is optional and should be used only to inform the analysis of Australian law. The sample plan asks that any comparator be justified, for example by a similar regulatory model or guidance Australian regulators have referred to.

What makes a good research question from these topics?

A good question is narrower than the topic. It names one problem, one part of the legal framework and the kind of answer you will give, and it leaves out related issues expressly so that the essay can analyse rather than survey.

Study strategy

Assessment move

Read all four topics and list, for each, the anchor document and two further primary sources you could locate this week. Draft a one-paragraph scope for your preferred topic using the context, objective, aim, questions and exclusion sequence. Keep market figures in your background section only, each traced to its original publication.

Keep a dated log of new regulator statements on your topic during the term, because the topic sheet rewards engagement with current developments. Revisit your scope paragraph each fortnight and cut anything your sources cannot support.
