Why should an order preserve future lawful action?

Compel an official to perform a duty rather than to exercise discretion in the applicant's favour. Restrain the unlawful step without preventing future lawful action. Frame a declaration around a real legal controversy. After each draft, ask what task remains for the administrator on reconsideration.

Add remedial discretion as a reasoned paragraph. Test delay, adequate alternative remedies, futility, applicant conduct and practical consequences against the supervisory purpose of the requested order. Avoid generic statements that relief is discretionary. Explain how each fact supports granting, shaping or withholding this particular remedy.

Where interim protection is relevant, distinguish preservation of the position from final relief. Finish with a day-after exercise. Describe the legal position immediately after the proposed order and the next lawful administrative step. If the order grants the substantive benefit despite unresolved statutory choices, it is probably too broad. If it leaves an unlawful decision operating without explanation, it is too weak.
